The purchase of all products and services, including, but not limited to: physical products, digital products, including PDF downloads and online material is subject to the following terms and conditions. Consumers are advised to review carefully before making any purchase. If you have any questions about whether a product is right for you, feel free to email us at create@blackbirdmedia.ca before making your purchase.

physical products

For all returns or exchanges, items must not be washed, worn, or damaged. All original tags must be attached. Gift cards may not be redeemed for cash or refunded.

You can return online purchases by mailing it back to us following the step-by-step instructions below. 

Regular Priced Merchandise
  • Within 10 days of the delivery date: you can send us a request for an exchange or a refund to the original method of payment.
  • If you do not send an email within 10 days of receiving your package: we reserve the right to no longer accept returns or exchanges.
  • If the return lowers your purchase order below the free shipping rate we will have to charge a restocking fee of $15.00.
Sale Merchandise
  • Within 10 days of the delivery date: you can exchange your item, or we’ll issue you a merchandise credit with a promo code available online. 
  • All items discounted at 50% and more are FINAL SALE. No exchanges, no refunds.

digital assets

Graphic design documents are downloadable files and no actual items will be shipped to you. Downloads are delivered upon confirmation of payment and due to the nature of the product and its delivery, no refunds are offered on completed projects. Should a request for work to be halted prior to completion of a project, a cancellation penalty may apply and will be assessed on a case-by-case basis. Down payments required to commence work on all projects are non-refundable.

marketing services

For all social media campaigns and other marketing services provided, the client is ultimately responsible for review and approval of all content put into market prior to distribution.  Blackbird Media will provide proofs for review by the client, which require formal written acknowledgement of review completion prior to Blackbird Media™’s execution of the campaign or marketing tactic. Any delays in timely review of these pieces may result in the delay of tactic deployment. In such circumstances, Blackbird Media™ is not responsible, nor beholding to the client for any reimbursement or credit for agreed upon work. As a courtesy to our clients, payment schedules for campaigns and recurring marketing services may be invoiced on a monthly or quarterly basis, dependent upon client preference. All payments for recurring work are due no later than intended date of deployment in order to commence work. Any client payment delays will result in campaign/project delay. Clients may cancel and renew without penalty provided 60-day notice via formal documented request. Blackbird Media™ may terminate this agreement at anytime with written notice to the client.

brand development

All Brand Guidelines are customized to the client’s exact business. No identical reports will be distributed to other clients and the content of same will remain confidential and proprietary to the client. However, Blackbird Media reserves the right to blind such outputs for case study and marketing purposes. Downloads of outputs from these offerings are delivered upon confirmation of payment in full and due to the nature of the product and its delivery, no refunds are offered on completed projects. Should a request for work to be halted prior to completion of a project of the above nature, a cancellation penalty may apply and will be assessed on a case-by-case basis. Down payments required to commence work on all projects are non-refundable.

print media

Design costs paid to Blackbird Media are non-refundable. We are not liable for damages incurred due to printing errors or problems from our files if full specifications from your printer were not provided or were incorrect/inaccurate, or if you supply the wrong files to your printer. We provide the design files via email or online only. No actual items will be shipped to you.

change of mind

For a Change of Mind refund request to be considered, it must be received by our Sales department within 15 days from the date of purchase. We do not require that you provide a reason for your request; however, your feedback would be appreciated. Change of mind refund requests are granted at the Sole Discretion of Blackbird Media and are subject to approval.  All change of mind refund requests must pass the terms and conditions outlined on this webpage to be eligible for refund consideration.  Change of mind refund requests are granted at our Sole Discretion. If a change of mind refund request is granted, the client will incur a 20% (twenty) percent processing fee, to cover the costs of refunding financial transactions and time spent on the client project. Change of mind refunds apply only to single purchases. When deciding to use a Blackbird Media product as part of a large solution, we strongly encourage you to review this policy before purchasing. In the case of web-based visible source products, we require that you supply us with the URL of where the product was in use prior to considering your request.

making a request

We must authorize all exchanges prior to return. Please contact us by email at service@blackbirdmedia.ca to make an exchange/refund authorization request within 10 days of the order’s delivery date. Please note that we are not responsible for delayed or lost packages. Please provide us with your order number and the style numbers of the merchandise you wish to return.

 

Your Return Package: 3 Steps To Prep

  1. If you saved your box, put the item(s) you want to return securely back in it, along with the original invoice , and securely seal the box.
  2. Stick the Prepaid Return Label we’ve provided on top of the original shipping label (make sure the previous label barcode is completely covered).
  3. Book a pick-up with the shipping carrier found on your Prepaid Return Label or drop off your package at the shipping carrier’s location.
shipping returns

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. Depending on where you live, the time it may take for your exchanged product to reach you may vary. If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

processing

Your refund will be credited to the original method of payment. Please note that initial shipping fees will not be refunded, if applicable. Any items received that do not comply with the above may be denied at the discretion of Blackbird Media. When your refund is complete, we’ll e-mail you right away and let you know.

IN NO EVENT SHALL Blackbird Media BE LIABLE TO CUSTOMERS FOR ANY INDIRECT, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE, LOST PROFITS, WHETHER OR NOT FORESEEABLE OR ALLEGED TO BE BASED ON BREACH OF WARRANTY, CONTRACT, NEGLIGENCE OR STRICT LIABILITY, ARISING UNDER THIS AGREEMENT, LOSS OF DATA, OR ANY PERFORMANCE UNDER THIS AGREEMENT, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY PROVIDED HEREIN. THERE SHALL BE NO REFUNDS. REVELATION CREATIVE MAKES NO WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, WITH REGARD TO ANY THIRD PARTY PRODUCTS, THIRD PARTY CONTENT OR ANY SOFTWARE, EQUIPMENT, OR HARDWARE OBTAINED FROM THIRD PARTIES.

Force Majeure

Neither party will be liable for, or will be considered to be in breach of or default under this Agreement on account of, any delay or failure to perform as required by this Agreement as a result of any causes or conditions that are beyond such Party’s reasonable control and that such Party is unable to overcome through the exercise of commercially reasonable diligence. If any force majeure event occurs, the affected Party will give prompt written notice to the other Party and will use commercially reasonable efforts to minimize the impact of the event.

By signing up for our services, you acknowledge that you have read and understand this Agreement and agree to be bound by its terms and conditions.
